SetKernel Digital Inc. respects your privacy and is committed to handling personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). EU visitors are additionally covered by the GDPR, and California residents by the CCPA.

Who we are

SetKernel Digital Inc., headquartered in Halifax, Nova Scotia, Canada, operates this website and is the data controller for any personal information collected through it.

What we collect

We collect personal information only when you choose to send it to us:

• Contact form submissions — name, email address, optional company name, optional service area of interest, and the content of your message.
• Newsletter signups — email address (required), plus optional name and optional role or company. Submitted via the newsletter form on the home page and writing index.
• Website health check — the website URL you ask us to audit and the email address you ask us to send the results to. A copy of the results also goes to our inbox so we can respond if you reply.
• "Email me my results" on the cost estimators and the technology check-up — email address and the answers or estimate summary you ask us to send. A copy also goes to our inbox.
• Resource downloads — email address (required) and optional name, submitted in exchange for the requested checklist.
• Usage analytics (only if you consent via the cookie banner) — anonymised page views, referrer URL, device class, and country. We do not collect IP addresses in identifiable form.

The health check, the "email me my results" forms, and resource downloads each also subscribe you to the same Resend-hosted mailing list as a newsletter signup. Every list email carries an unsubscribe link.

We do not collect names, addresses, payment details, or any other category of personal information through casual site usage.

Why we collect it

• Contact submissions — to respond to your inquiry.
• Newsletter signups — to send the occasional note you opted in for (case studies, new free tools, engineering essays). Optional name and role/company help us address you appropriately and understand who's reading; they are never used for ad targeting.
• Health-check, estimator, check-up, and resource submissions — to email you the results or checklist you requested, to follow up if you reply, and to send the occasional list note described above. Newsletter signups and resource downloads also receive up to two scheduled follow-up notes in the weeks after signup.
• Usage analytics — to understand which content is read and to improve the site.

We do not sell personal information, do not use it for advertising profiling, and do not share it with parties other than the processors named below.

Processors

The following third parties may process personal information on our behalf:

• Cloudflare, Inc. (Workers, Workers Logs, edge cache, Web Analytics beacon) — processes site requests and serves cached responses. Cloudflare Web Analytics is a cookieless server-side beacon that counts page views without setting cookies and does not require consent.
• Cloudflare Turnstile (anti-bot challenge, contact page only) — when the contact form is rendered or submitted, your browser is presented with a Cloudflare-hosted challenge that processes your IP address, basic device characteristics, and behavioural signals (e.g. mouse and timing patterns) to determine whether you are a human visitor. The challenge is strictly necessary to prevent abuse of the form and does not require explicit consent under PIPEDA or the ePrivacy Directive. Active only on the /contact page.
• Resend, Inc. (transactional email delivery and mailing-list management) — receives and delivers the contents of your contact-form submission to our inbox; stores mailing-list signups (email, optional name, optional role/company) from the newsletter, health-check, estimator, check-up, and resource-download forms on our behalf as one managed audience list; sends the welcome email, the emails carrying your requested results or checklist, the scheduled follow-up notes, and any subsequent broadcasts. Unsubscribe links are auto-injected by Resend on every list email.
• Google LLC (PageSpeed Insights API) — when you run the website health check, the website URL you submit is sent to Google's PageSpeed Insights API to produce the audit scores. Only that URL is sent; your email address is not shared with Google.
• Google LLC (Google Analytics 4) and Microsoft Corporation (Clarity) — only if you consent to analytics via the cookie banner, and only as described on our cookies page.

Retention

• Contact submissions — retained in our inbox until manually deleted, typically within 12 months of last interaction.
• Mailing list (newsletter, tool-result, and resource-download signups) — retained for as long as you remain subscribed. You can unsubscribe at any time via the link in any list email, or by emailing hello@setkernel.com. Unsubscribing removes you from the Resend-hosted audience and stops all future sends.
• Worker request logs — 7 days (Cloudflare Workers Observability default). Per-request logs may include request URL, timing, and IP-derived geo data; do not include contact form contents.
• Consent state — stored in your browser's local storage; we do not retain it on our servers.

Your rights

Under PIPEDA you have the right to access the personal information we hold about you, request correction, and withdraw consent to its use.

If you are in the European Union, the GDPR additionally gives you the right to rectification, erasure, restriction of processing, data portability, and to object to processing.

If you are a California resident, the CCPA gives you the right to know what we have collected, to delete it, and to opt out of any sale or sharing of personal information. We do not sell personal information.

How to exercise your rights

Email hello@setkernel.com with your request. We will respond within one business day and complete the request within 30 days.

If we cannot resolve a privacy concern to your satisfaction, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.

Children

This site is not directed at children under 13 and we do not knowingly collect personal information from children.

Changes to this policy

We may update this policy when our processors, retention practices, or legal obligations change. Material changes will be reflected by an updated revision date below and, where appropriate, by a notice on the site.
